Subtlehaus Residency Agreement

This is the agreement template, provided for review before applying. The binding agreement is formed when an accepted artist completes and submits the Residency Agreement form; the residency period and amount due follow the details entered there.

Subtlehaus Residency Agreement

This Agreement is entered into between Party A (Chang Wei-Ting) and Party B (the applicant named in the Residency Agreement form). Where more than one artist stays, or the resident is accompanied, occupancy is capped at three people including at most one child.

1. Residency Address

Ōtori area, Nishi-ku, Sakai, Osaka, Japan (full address provided upon confirmation).

2. Residency Period

As stated in the check-in and check-out dates entered in the Residency Agreement form.

3. Fees & Payment

  • Fee-free period (8 days): Party B pays utilities of NT$100 per person per night.
  • Extended stay: NT$600 per night for the whole house, utilities included.
  • The above amounts are before tax; 5% business tax is added to the total.
  • Payment: the full amount is paid online via ECPay upon submission of the Residency Agreement form; the booking is held only once payment is complete. Where a different amount has been agreed with Party A, payment follows the instructions given by email.
  • Use of funds: all fees go toward house maintenance, repairs, utility and tax bills.

4. Use of the Space & Responsibilities

  • Keys: Party A posts the keys to the designated address in Taiwan 10 days before departure. Keys must be kept safely; loss incurs compensation of NT$1,000. Keys must be posted back to the Taipei office within seven days of check-out.
  • Cleaning: before check-out, the space must be cleaned, waste removed and items returned to their places.
  • Conduct: no smoking indoors; reduced volume after 9 p.m.; visitors must be announced in advance and overnight guests are not permitted.
  • Equipment: damage to furniture, appliances or facilities caused by improper use is compensated in full by Party B. Consumables (toilet paper, kitchen towels, etc.) are replaced by residents.
  • Internet & safety: the house does not provide WiFi; residents arrange their own SIM or eSIM. Candles, open flames and other high-risk activities are prohibited.
  • Disclaimer: Party A accepts no liability for personal injury, accidents or loss of property arising from Party B's own conduct during the residency.

5. Intellectual Property

  • Ownership: all works created by Party B during the residency remain Party B's intellectual property.
  • Promotional licence: Party B grants Party A a non-exclusive, royalty-free licence to use materials produced during the residency (photos, videos, texts, etc.) for the program's promotion, publicity, website display and social media.
  • Attribution: when exhibiting or publishing work created at Subtlehaus, Party B credits or mentions the residency.

6. Breach & Changes

  • Cancellation: once confirmed, the booking cannot be cancelled or rescheduled except in cases of force majeure; breach forfeits future eligibility.
  • Program obligations: during the stay, Party B tags @reflection.tw in published photos or videos; within 7 days of check-out, Party B completes the feedback form and consents to promotional use of materials.
  • Termination: Party A may terminate this Agreement unilaterally in the event of breach or serious disturbance to neighbours.

7. Statements & Disputes

  • Nature of the property: this is not a hotel or guesthouse but Party A's personal property offered as a non-profit residency space.
  • Local enquiries: if neighbours or local residents ask, Party B should answer that the accommodation is "provided by a friend".
  • Disputes: the parties agree that the Taipei District Court, Taiwan, shall be the court of first instance.
